Miss. AG sues administrator of BP oil spill fund (AP)
JACKSON, Miss. ? Mississippi's attorney general said Tuesday his office is suing the administrator of BP's $20 billion oil spill fund to get access to claims filed by coastal residents.
Jim Hood said Tuesday that he has tried to negotiate with the fund's administrator, Washington lawyer Kenneth Feinberg. He says he's seeking to make the process more transparent so people will know if Feinberg is looking out for the best interests of oil spill victims or BP.

Hood has previously said he believes Feinberg's operation is intentionally delaying and denying legitimate claims, an allegation Feinberg has denied. Others have also criticized the size and pace of payments and a perceived lack of transparency.
Feinberg has said Hood could undermine the claims process by urging a court to intervene and by making allegations that border on defamation.
Hood said he believes if Feinberg would "open the books for Mississippi claims, we will find they have not treated our claims fairly."
"If you don't have anything to hide, show your hand," Hood said.
Hood said he resorted to the lawsuit because his office's attempts to get access to the documents on Mississippi claims failed. He did say BP and Feinberg have responded with some documents but not everything requested.
"He has provided very little transparency in this process," Hood said at a news conference in his Jackson office. "All we want them to give us how they arrived at these (claim) figures. We have worked with him every way in the world. All they have done is delay."
"All he has done is come down to our coast and tell us all these good things he was going to do and he hasn't done them," Hood said. "It is going to take a judge, I think, to require him to make disclosure."
Hood said he expects BP to try to move the lawsuit to federal court in New Orleans, where other BP cases are being handled.
However, in the lawsuit, Hood said his investigation into the claims process falls under the Mississippi Consumer Protection Act and of purview of the state courts.
"The attorney general has not made any determination as to the merits of a future enforcement action. Instead, the attorney general is performing his duty to investigate suspected violations of Mississippi law," the lawsuit says.

JPMorgan quarterly profit rises, loan book grows (Reuters)
NEW YORK (Reuters) ? JPMorgan Chase & Co posted a higher-than-expected jump in second-quarter profit as it wrote off fewer bad mortgages and credit card loans.
The second-largest U.S. bank managed to make new loans faster than customers paid off existing ones during the quarter, a reversal from the first quarter and a bright spot for a sector long plagued by weak loan demand.
JPMorgan's revenue rose and it added staff, and its shares were up 2.75 percent in afternoon trading.
But the bank still faces stiff headwinds, including big expenses from mortgages as the effects of the housing crisis linger.
Foreclosures could take another 12 to 18 months to start declining, Chief Executive Jamie Dimon said on a conference call with reporters.
"JPMorgan's revenue growth is a sign that things are getting better. They're just not getting better quickly," said Ralph Cole, portfolio manager at Ferguson Wellman Capital Management in Portland, Oregon. Ferguson Wellman owns JPMorgan shares.
Although loans at the end of the second quarter were up from the end of the first quarter, average loans outstanding during the latest quarter declined, signaling that even if loan demand is improving, growth is uneven.
JPMorgan is the first major U.S. bank to post quarterly results, and its performance gives hints about how other banks fared in the period.
BOND TRADING
Bond trading revenue fell 18 percent from the first quarter, but the decline was less than some investors had feared. Shares of investment banks Goldman Sachs Group Inc and Morgan Stanley initially rose on hopes that JPMorgan's trading results bode well for the sector, but turned negative later in the day.
JPMorgan earned $5.43 billion, or $1.27 a share, in the second quarter, beating the average Wall Street estimate by 6 cents a share, according to Thomson Reuters I/B/E/S.
The results were up from year-earlier earnings of $4.8 billion, or $1.09 a share.
The bank benefited from not having to pay a British tax on bonuses. In the year-earlier period, that tax reduced profits by $550 million, or 14 cents a share.
JPMorgan made more loans during the quarter, net of customer loan repayments. Its loan book grew to $689.74 billion at the end of the quarter from $686 billion at the end of March as increased business lending offset a 2 percent decline in consumer lending.
The bank also gathered more deposits during the quarter; deposits surged by 5 percent from the first quarter to $1.05 trillion. Chief Financial Officer Douglas Braunstein said mid-sized companies delivered much of the money.
Deposits could support more loans in the future, if there is enough demand.
Shrinking loan books and low interest rates since 2008 have made it difficult for banks to post profits, or increase them. A large part of earnings over the past year has come from setting aside less money to cover bad loans, or dipping into funds previously set aside.
Many analysts are hoping banks will start to post loan growth in the coming quarters, which would be a sign of sustainable increases in profits.
Dimon, who is famously blunt, seemed optimistic about the outlook for profits. He said the bank will build capital levels in the coming months, and criticized regulators for not allowing it to return those funds to shareholders faster.
"God knows why we have to hold all that capital," Dimon said, adding that banks' capital ratios are going "to drive up so fast people are going to be surprised."
Banks returned billions of dollars of capital to investors in 2007 and 2008, even as large clouds gathered over the mortgage market.
JPMorgan reduced the expense it recorded for credit costs to $1.81 billion in the second quarter from $3.36 billion a year earlier. However, that was up from $1.17 billion in the 2011 first quarter.
JPMorgan shares were up 2.8 percent to $40.73 in afternoon trading following the results.
TAKING TIME WITH MORTGAGES
Dimon said in the earnings announcement that mortgage costs were down slightly, but cautioned that the housing market was still working through difficulties.
"Unfortunately, it will take some time to resolve these issues and it is possible we will incur additional costs along the way," he added.
In a sign of the lingering difficulties that banks are facing with home loans, JPMorgan said it expects to have to repurchase $3.6 billion of mortgages that it packaged into bonds. Such repurchases are usually because a bank failed to properly collect payments on the mortgages, or should never have sold them to investors in the first place.
JPMorgan said it added $1.3 billion to its litigation reserves, mainly for mortgage-related matters. It also continued to add to its loan reserves for losses on mortgages.
"It is possible we are very over-reserved in mortgage land," Dimon said in a conference call with analysts.
He expects to win a legal battle with the Federal Deposit Insurance Corp over liabilities left from busted lender Washington Mutual, pieces of which JPMorgan bought in a government-arranged deal during the financial crisis.
Credit card delinquencies are improving so quickly that the bank drew down its reserves for losses on those balances, adding 15 cents a share to second-quarter profit.
The charge-off rate for uncollectible card debt will be down to about 4.5 percent this quarter, nearly a year earlier than previously expected, said Chief Financial Officer Douglas Braunstein. The improvement echoed comments Wednesday from card lender Capital One Financial Corp.
JPMorgan has been hiring people to work out its problems with mortgages, still the biggest drag on its business. The bank said it hired 10,000 people in the second quarter. Employment at the bank reached 250,095 people at the end of June.
At the same time, compensation expenses slid in the last three months as pay for employees in the investment bank declined 22 percent from the first quarter when trading revenue shrank. Compensation costs at the investment bank fell by $730 million to 35 percent of revenues, down from 40 percent in the first quarter.
The decline in pay at the investment bank shows Dimon's strength at keeping costs in line with JPMorgan's business volumes, said Credit Suisse analyst Moshe Orenbuch.
"When revenues are down, JPM manages to bring down their costs faster than everyone else. That really did cushion some of the earnings decline," said Orenbuch.

But the talks ended with no joint statement and no action plan, a sign the grouping remains divided on how to move forward.
The Palestinians say they will not return to the negotiating table without a freeze on settlement construction and clear parameters for new talks, including that any borders will be based on the lines that existed before the 1967 Six Day War, with mutually agreed land swaps.
But Israel has rejected any new settlement moratorium, and says setting preconditions for talks prejudges the substance of negotiations.
The stalemate has left the Palestinians more determined to seek UN membership at a meeting of the General Assembly in September, despite Washington's explicit opposition to the move.
"We have been told by the Americans many times that they'll use a veto at the Security Council against our bid for admittance and we were told that at the General Assembly if we pursue that line at there'll be consequences," Erakat said.
"Without Security Council approval, we cannot get admittance by the General Assembly," he said, adding the Palestinians could however seek to have their status upgraded to a non-member state by the General Assembly.
Palestinian president Mahmud Abbas is scheduled to meet on Thursday in Qatar with Arab representatives to discuss the legal aspects of the UN bid.
The Palestinians have insisted they do not see the plan as contradicting new peace talks.
But Erakat said he did not believe the Israeli government would agree to set parameters for negotiations, or accept using the pre-Six Day War lines as the basis for negotiations.

It is my strong belief that obesity would be easier to prevent than to treat, so the main focus of this unit will be educating students to make healthy food choices, build self-esteem and exercise on a daily basis. Diet management, heredity, metabolic factors, social and emotional disorders will be explored.
This unit will be taught at Dimner Beeber Middle School, located in the Wynnefield section of the city, to 6th, 7th, and 8th grade students during their Science Lab classes. The periods are seventy five minutes long and the students come once a week. The lessons from this unit may be adapted for classes of different lengths.
Childhood Obesity in America
Rationale
Acknowledging and evaluating the current rise in obesity in the United States and throughout the world is important for many reasons. Scientifically, when a problem is clearly defined, its solutions or remedies etc. may have dramatic effects on the targeted population. The benefits may be long or ever-lasting.
Raising self-esteem, making healthy food choices and exercising on a regular basis may be the rewards of attention given to the health problem of childhood obesity today. The main focus of this unit will be to raise awareness of the problem of childhood obesity and present possible ways of preventing this problem through maintaining a healthy lifestyle.
Prevention is recognized as the primary, and most efficient, means to combat obesity. However, many children and adolescents who are already overweight or obese require assistance both to prevent further weight gain and to prevent development of obesity-related co-morbidities in adulthood (Hills, King and Byrne 2007).
In this unit suggestions will be made, strategies developed and lessons planned to address this problem of obesity at Beeber Middle School. There are 507 students currently enrolled, and I have the Body Mass Indexes of 440 of the students that were screened by the school nurse.

1% of the students fall into the underweight percentile, 68% of the students fall into the normal or average percentile, 3% of the students fall into the at risk of becoming obese and 28% of the students are obese. The majority of the students fall into the normal range, however, 31% of the students fall into the ?at risk? or obese range.
BMI is calculated as weight(kg)/height(m2) or weight(lb)/height(in2)
x 703. The result is plotted against age on a gender-specific BMI curve(Fig. 5.1and 5.2).
BMI will help identify children who are obese (BMI >95th percentile), overweight (BMI between the 85th and 95th percentiles), normal weight (BMI between the 5th and 85th percentiles), or underweight(BMI under the 5th percentile for age and gender).
When applied to an individual child, the calculation of BMI allows for classification and prompts further evaluation of individual risk factors for obesity and obesity-related co morbidities. (Hassink 2007)
The BMI classification method is still deemed to be contentious by some researchers. For example, some argue that BMI standards apply mainly to the populations whose data were used to determine the cutoff points (Fu et al., 2003; Misra, 2003). Others defend the present cutoffs and contend that they are simple, uniform definitions of overweight and obesity that hold across populations (Stevens, 2003). Despite the ongoing debate regarding cutoff points to define obesity, in agreement with Cole et al. (2000), the choice to use the BMI cutoff percentiles passing through the adult BMI cutoff point of 30 seems to be reasonable (Luciano et al., 2003). However, the use of population-specific cutoff points would clearly be the preferable choice, where available. In contemporary children, fat-free mass (FFM) and fat may contribute in the same way to the values of BMI as for the reference child (Wells et al., 2002). BMI also correlates with other parameters. For example, there is a slightly higher correlation between BMI and subscapular skin fold than weight-for-height index and the same parameter. This is also true for other cardiovascular risk factor variables (blood pressure, serum lipids, and lipoproteins) regardless of age-for-sex groups. However, weight-for-height measures are not superior to BMI as an indicator of obesity (Frontini et al., 2001).A study by Wright et al., (2001) found BMI at age 9 was significantly correlated with BMI at 50, but not with percentage of body fat. After adjustment, BMI correlated with selected health risks. (Parizkova and Hills)
The current rise in the attention given to the increase in childhood obesity has been accompanied by a growing body of literature investigating the relationship between potential risks of obesity and body fatness and the associated preventative measures. We know that there are some risk factors that affect some children more than others. However, there are certain risk factors that can predict a child?s chance of becoming obese. A systematic review (Parsons et al., 1999) identified seven risk factors: parental fatness, social factors, birth weight, timing or rate of maturation, physical activity, dietary factors and other behavioral or psychological factors. With these factors in mind, the lessons of this unit will address making healthy choices for maintaining a health lifestyle.
Objectives
Most children, given information about making healthy food choices, will see a reduction in overweight or obesity, or not become at risk of gaining excess body fat, if they maintain a rigorous physical regimen or increase daily exercise. The goal of this unit is to help children maintain a healthy body weight by making healthy food choices while
exercising daily. The students will be taught to recognize the importance of physical activity, the importance of a balanced diet, understand the importance of adequate relaxation and sleep and develop or maintain a positive self-image.
Strategies
Students will use a variety of resources, instructional input and hands-on activities. They will evaluate web sites, compare nutrional values and calculate BMI to help them maintain a healthy lifestyle.

Lesson One
What Factors Affect a Healthy Lifestyle? -1
Pre-class -Students will discuss in small groups the factors they think will affect a healthy lifestyle. 5-7 minutes.

Lesson Two
What is Exercise and Its Benefits?
Pre-class - Have students list all the activities that they consider to be exercise. 5-7 minutes.

Students will research the benefits of exercise using a website.
In small groups students will plan exercise activities that can be used during 10, 20, or 30 minute periods (jumping jacks, sit-ups etc). Students can compile activities to be done in a circuit, rotating every 2 or 3 minutes, depending on the time period and the amount of activities to be done.
Assessment: Encourage students to use what they have created on a daily basis. Have them write about any changes or new ideas.
Lesson Three
Self?Management / Self-Esteem
Pre-class - Have students brainstorm various aspects of his/her life which may need changing. 5-7 minutes
Classwork: Students will develop a self-management system that can be used in everyday life.
Part 1 - Have students list at least five strategies for maintaining a healthy or a balanced lifestyle. (Example - healthy diet, exercise, proper amount of sleep, release of stress, relaxation etc). 10-20 minutes
Part 2 - Students will make a chart utilizing the strategies for self-management, diet and exercise. The chart should allow them to record, on a daily basis for at least a week, information including amount of time spent exercising, sleeping and pursuing leisure time. The chart should also include space to record the amount of food and drink consumed. 10-20 minutes
Assessment: Have students set goals for themselves and maintain a daily diary/log on the strategies they felt were important for a balanced, healthy lifestyle. Students should share what they have written periodically.

Governors Fitness Challenge
Governor Edward Rendell has issued a challenge for Pennsylvania?s school children to make life-long healthy food choices. Specifically the Governor wants the children to maintain good nutrition with daily activity in an attempt to reduce overweight and obesity in our state. This unit will support the Governor;s initiative by offering opportunities for our children and their families by providing information to help them make healthy food choices while exercising daily. The 5-2-1 rule will be promoted.
